Preparing Canadian documents for use in another country can involve several different requirements. Apostille Services in Canada

Canada became a party to the Hague Apostille Convention on January 11, 2024. As a result, eligible Canadian public documents being presented in another Hague Convention country can receive an Apostille Certificate.

An apostille authenticates the origin of a public document by verifying elements such as the signature, seal or stamp, and the capacity of the official who signed it. It does not verify the truth of the document’s contents.

Not every document needs to be notarized before receiving an apostille. For example, Ontario permits certain vital-statistics records, qualifying business-registry documents, newer Ontario court documents, and qualifying public post-secondary credentials to be authenticated directly.

Authentication Services for Non-Hague Countries

Not every country participates in the Hague Apostille Convention.

When Canadian documents are intended for a non-Hague country, the process may involve a Certificate of Authentication rather than an apostille, followed by any additional legalization required by the destination country’s embassy, consulate, or receiving authority.

Ontario’s ODS, for example, issues apostilles for Hague Convention destinations and certificates of authentication for non-Hague destinations.

Because requirements vary considerably between countries, it is important to determine the destination country’s requirements before beginning the process.

Ontario currently states that documents notarized remotely are not accepted by ODS for authentication or apostille; therefore, documents intended for that process should be prepared in accordance with the applicable requirements.

Canada-Wide Document Support

The Canadian apostille system is not handled by one office for every document.

Provincial competent authorities currently operate in Ontario, Alberta, British Columbia, Quebec, and Saskatchewan for documents falling within their respective jurisdictions. Certain federal documents and eligible documents from provinces and territories without their own designated competent authority are handled through federal channels such as Global Affairs Canada.

This makes correct routing an important part of the process.
